Derecho a la presunción de inocencia

Este es quizás el derecho más importante. Significa que sos inocente hasta que se demuestre lo contrario. La carga de la prueba está en la fiscalía que tiene que presentar pruebas suficientes para derribar la presunción de inocencia. Vos no tenés que probar tu inocencia.Un principio relacionado es el principio in dubio pro reo que significa que en caso de duda se debe fallar a favor del acusado. Derecho a no declarar contra uno mismo

Nadie puede ser obligado a declarar contra sí mismo o a confesarse culpable. Vos tenés el derecho a guardar silencio durante todo el proceso si así lo deseas. Tu silencio no puede ser usado en tu contra para presumir culpabilidad.También tenés derecho a no contestar preguntas que te puedan incriminar. Por ejemplo, durante un interrogatorio policial o en el estrado durante el juicio.

Derecho a la defensa y asistencia letrada

Desde el primer momento en que sos detenido o acusado formalmente tenés derecho a la asistencia de un abogado defensor que vele por tus derechos. Si no podés pagar uno, se te debe asignar un defensor público gratuito.Tu abogado debe estar presente en todos tus declaraciones y tiene derecho a recomendarte que no respondas preguntas que te puedan perjudicar. También puede contrainterrogar testigos de la fiscalía y presentar pruebas a tu favor.

Derecho a un juicio justo

Tenés derecho a que tu juicio se lleve en un tiempo razonable por un juez imparcial que base su decisión solo en las pruebas presentadas durante el juicio. No puede haber influencias externas o presiones políticas o sociales sobre el juez.También tenés derecho a conocer todas las pruebas en tu contra para poder refutarlas. Esto incluye declaraciones de testigos que la fiscalía piense presentar.

Derecho a recurrir el fallo

Si sos declarado culpable, tenés derecho a apelar el fallo ante una instancia superior. Ahí se analizará si se siguieron correctamente los procedimientos, si las pruebas eran válidas y suficientes para una condena y si la sentencia fue apropiada.Estos son algunos de los derechos fundamentales que te amparan durante un proceso penal. ¡Es importante que los conozcas y los ejerzas!
