NY Penal Law § 220.39: Criminal sale of a controlled substance in the third degree There are a handful of offenses prohibiting selling drugs in the New York Penal Code. The majority of them require that you sell or attempt to sell a minimum quantity of specific types of drugs in order to be prosecuted. Under New York Penal Code § 220.39, you will have committed the crime of criminal sale of a controlled substance in the third degree if you knowingly and unlawfully sell illicit drugs as follows:
- A narcotic drug,
- A minimum of 1 gram of a stimulant,
- A minimum of 1 milligram of Lysergic acid diethylamide,
- A minimum of 25 milligrams of a hallucinogen,
- A minimum of 1 grams of a hallucinogenic, or
- A minimum of 1/8 of an ounce of Methadone.
