What to Do When FBI Agents Raid Your Home or Business
So you’re probably waking up to pounding on your door at 6 AM and it’s the FBI with a search warrant. Maybe they’re investigating your business for fraud. Maybe someone reported you for tax issues. Or maybe you’re just caught up in someone else’s federal case. Look, we get it. You’re ABSOLUTELY TERRIFIED. And you should be! Because destroying ANY evidence during an FBI raid carries 20 YEARS in federal prison and lying to agents means another 5 years!
Why Do FBI Raids Happen at Dawn?
Let me explain the psychological warfare you’re experiencing. FBI deliberately raids at dawn to catch you vulnerable and confused – when you’re in pajamas, half-asleep, and most likely to say something stupid! They show up with 20 agents in tactical gear, guns drawn, screaming commands! Your neighbors watching! Your family crying! It’s designed to terrorize you into cooperation! We’ve seen executives literally wet themselves from fear during these raids!
Here’s what’s really scary – FBI routinely oversteps warrant authority and seizes everything! They’ll take computers not listed! Photograph items they can’t seize! Record conversations outside warrant scope! One client had FBI take his grandmother’s jewelry claiming it was “proceeds of crime”!
What Powers Does the Search Warrant Give FBI?
The warrant seems limited but FBI stretches it beyond recognition! It specifies locations to search – but they’ll tear apart EVERYTHING! Warrant says “office”? They search your car in driveway! Says “computers”? They take every electronic device including your kids’ iPads! We’ve seen agents literally rip open teddy bears looking for hidden USBs!

(212) 300-5196FBI can detain everyone present during search – you’re trapped! Can’t leave to call lawyer! Can’t go to bathroom without escort! They separate family members and interrogate each one! Your teenage kids getting questioned about your business! The “plain view” doctrine lets them seize anything suspicious they see – even if not in warrant! That prescription bottle on counter? Evidence of drug dealing! Stack of cash for vacation? Money laundering! Personal diary? Confession! Everything becomes criminal evidence!
Can I Refuse to Let FBI In?
NO! Refusing entry with valid warrant is FEDERAL OBSTRUCTION! Obstruction of federal investigation under 18 USC 1510 means immediate arrest! They’ll break down your door! Add resisting charges! Use it as consciousness of guilt at trial! We’ve seen people get 5 extra years just for asking to read warrant before letting them in!

You're getting ready for work on a Tuesday morning when a dozen FBI agents arrive at your front door with a search warrant, demanding entry to seize your computers, phones, and financial records related to a wire fraud investigation you knew nothing about. Your teenage daughter is home, your spouse is panicking, and agents are already moving toward your home office.
What should I do right now while the FBI is inside my house searching through everything?
First and foremost, do not physically interfere with the agents or attempt to destroy, hide, or move any documents or devices — obstruction under 18 U.S.C. § 1519 carries up to 20 years in prison. You have the right to remain silent under the Fifth Amendment, so politely decline to answer any questions and immediately call a federal defense attorney. Ask to see the search warrant and carefully note its scope — agents can only search areas and seize items specifically described in the warrant as authorized under the Fourth Amendment and Federal Rule of Criminal Procedure 41. Document everything you observe, including which agents are present and what they take, because any seizure beyond the warrant's scope can be challenged through a suppression motion.
This is general information only. Contact us for advice specific to your situation.
But here’s the trap – if you consent to search WITHOUT warrant, you waive all Fourth Amendment rights! They knock and ask “nicely” to look around? Say NO! Demand warrant! Once you consent, they can search anywhere and use everything against you!
