SIIS in Nevada – What is it?

What Was the State Industrial Insurance System (SIIS) in Nevada?

The Rise and Fall of Nevada’s State-Run Workers’ Comp Program

Back before the year 2000, if you were an employer in Nevada, you HAD to buy your workers’ compensation coverage through a state-run agency known as the State Industrial Insurance System, or SIIS for short. That’s right – the state government had a total monopoly on workers’ comp insurance. Private insurers were not allowed to sell policies.Why did Nevada structure things this way? Well, the idea was that having a single state-run system would keep costs down and ensure all employers could afford coverage to protect their workers. But in reality, SIIS turned into a bureaucratic mess. Here are some of the major problems that plagued the system:

  • Mismanagement and inefficiency
  • Paying out way more in claims than it collected in premiums
  • Racking up huge unfunded liabilities
  • Failing to keep up with technology and best practices

By the late 1990s, it was clear that SIIS was unsustainable. Employers were frustrated with the lack of options and service. Injured workers faced delays and red tape in getting their benefits. The whole system was on the verge of collapse. Something had to change.

The Switch to Privatization

Recognizing these serious issues, in 1999 the Nevada legislature passed a bill to privatize the workers’ compensation insurance market. The goal was to open things up to competition, allowing private insurers to enter the market and offer employers a choice of providers.The privatization process happened gradually over a few years:

  • In 2000, SIIS was converted into a mutual insurance company called Employers Insurance Company of Nevada (EICN).
  • For a transitional period, EICN continued to be the “insurer of last resort” required to offer coverage to any Nevada business.
  • But by 2002, the market was fully opened up, with over 100 private insurers approved to sell workers’ comp policies in the state.

So what happened to SIIS? It essentially went away, replaced by a combination of EICN and other private insurers. Today, Nevada employers can shop around and choose any licensed insurer for their workers’ comp needs. The state no longer has a government-run insurance fund.

How the New System Works

Under Nevada’s privatized system, most employers are still required to carry workers’ compensation insurance or be self-insured. It’s the law. But you get to pick your provider. Some key things to know:

  • You can buy a policy from any insurer licensed to write workers’ comp in Nevada. There are many options to choose from.
  • Premiums and services vary between insurers. It pays to shop around for the best fit for your business.
  • Some large employers with a solid safety record can be self-insured. But this requires state approval.
  • For smaller businesses and riskier industries, there are insurance pools and assigned risk plans available to ensure coverage is accessible.

As for injured worker benefits, those are still governed by state law no matter which insurer is providing coverage. All insurers must abide by the same statutes when it comes to things like:
