THE BEST LAWYER ANYONE COULD ASK FOR.

The BEST LAWYER ANYONE COULD ASK FOR!!! Todd changed our lives! He’s not JUST a lawyer representing us for a case. Todd and his office have become Family. When we entered his office in August of 2022, we entered with such anxiety, uncertainty, and so much stress. Honestly we were very lost. My husband and I felt alone. How could a lawyer who didn’t know us, know our family, know our background represents us, When this could change our lives for the next 5-7years that my husband was facing in Federal jail. By the time our free consultation was over with Todd, we left his office at ease. All our questions were answered and we had a sense of relief.

What is a Class A Felony?

A class A felony is the most serious type of felony crime in many states’ criminal justice systems. Let’s break down what makes a class A felony so severe and some examples of these types of offenses.

Defining Key Characteristics

There are a few key characteristics that define a class A felony charge:

  • Carries longest prison sentences – We’re talking decades behind bars here, folks. Class A felonies carry the harshest and lengthiest prison terms out of all felony classes, ranging from 10 years to life in prison.
  • Life sentence possible – In some states, a class A felony conviction can result in a life sentence in prison without the possibility of parole. That’s essentially dying in jail.
  • Fines up to $50,000 – These types of felonies often come with monster fines of up to fifty grand. Most people don’t have that kind of money laying around.
  • Called “capital felony” in some states – You’ll hear class A felonies referred to as capital felonies in states like Texas and Florida. It’s basically their version of the same extreme criminal charge.

So in a nutshell, class A felonies are no joke – they can land you behind bars for decades and cost you everything. Let’s look at some examples.

Most Common Class A Felony Offenses

There are a range of offenses that can and often do trigger class A felony charges. These include:

Murder

  • This one is probably not a huge shocker. First and second degree murder charges almost always carry class A felony status. Intentionally taking someone’s life is about as serious as a crime can get.
  • Even “heat of passion” manslaughter will sometimes get escalated to a class A felony depending on state laws and case circumstances.
  • Expect to serve decades in prison or even life without parole if convicted of murder as a class A felony.

Rape

  • In most states, rape – particularly aggravated rape or rape of a child – is prosecuted as a class A felony.
  • Forced sexual crimes are considered incredibly serious offenses that carry severe prison terms. We’re talking at least 10-15 years behind bars.

Kidnapping

  • Holding someone against their will is no light matter in the criminal justice system’s eyes.
  • Kidnapping cases that involve transporting the victim to a secondary location, ransom demands, child victims, or sexual assault often rise to the level of a class A felony.
  • Expect a very long sentence if convicted.

Treason

  • Betraying one’s country through levying war against it or providing aid to its enemies is prosecuted as treason.
  • While rare, treason is considered an extremely serious federal class A felony offense that carries grave penalties. We’re talking 20+ years in federal prison or even life behind bars.

Drug Trafficking

  • In all states, drug trafficking – meaning manufacturing, distributing, selling, or importing massive quantities of illegal drugs – is prosecuted as a class A felony.
  • The exact drug thresholds for triggering a class A felony charge varies by state but typically involves dozens of pounds of marijuana, kilos of cocaine/heroin/meth, or thousands of dosage units.
  • These cases can result in up to life sentences in states like New York.

So in summary, class A felony charges are reserved for the most dangerous, harmful and serious criminal offenses that violate critical social norms and put public safety at grave risk. The sentences match the severity.

Defending Against Class A Felony Charges

Facing a potential class A felony conviction is scary. Decades behind bars is no joke. But skilled criminal defense attorneys can often negotiate reduced charges or acquittals in these high-stakes cases. Common defenses include:

  • Misidentification – Mistaken identity is more common than you’d think. Eyewitnesses can be unreliable. Fingerprint or DNA evidence contaminated. Proving the defendant is not actually the perpetrator can defeat a class A rape or murder charge.
  • Self-defense – Killing or harming another person is justified if it occurred while defending yourself or others from imminent grave harm. Self-defense against rape, kidnapping or violent assault can eliminate or reduce a class A charge.
  • False accusations – People sometimes lie and falsely accuse others of horrific crimes out of jealousy, anger, mental illness or a desire for attention or fame. Demonstrating witnesses fabricated allegations can defeat serious felony charges.
  • Entrapment – Undercover cops sometimes improperly coerce or induce people who wouldn’t normally break the law into committing “crimes”, like buying drugs. This common defense can defeat serious felony narcotics distribution charges.

The bottom line is that just because someone gets slapped with a class A felony charge does not necessarily mean they will be convicted as charged. There are often strong defenses worth raising. Anyone facing this kind of accusation should retain an experienced criminal defense lawyer right away. The stakes are extremely high.

How Class A Felonies Impact Immigration Status

Class A felony convictions can be absolutely devastating for non-citizen defendants. Why? Because they almost always trigger deportation and permanent exile from the United States.

  • Aggravated felonies – Class A felonies fall under the “aggravated felony” category in immigration law, which carries the harshest penalties.
  • Mandatory detention – Those accused of class A felonies often get locked up in immigration detention facilities during prosecution.
  • Deportation – One convicted of an aggravated felony at any time after admission to the U.S. loses their immigration status and gets deported.
  • Permanent bar on re-entry – Those deported for aggravated felonies can never lawfully return to America – even as a tourist or to see family.

As you can see, for those hoping to build a life in America, a class A felony allegation is incredibly high stakes. The conviction won’t just land them in state prison – it will get them deported and permanently banned from the U.S.

Takeaways

The bottom line is that class A felonies are extremely severe criminal charges reserved for the most dangerous crimes like murder, rape, kidnapping, treason and high-level drug trafficking. They come with very harsh prison sentences – decades behind bars or even life without parole. Class A felonies also devastate immigration status, triggering mandatory deportation and permanent exile for non-citizens. So anyone facing accusations of this magnitude needs to hire an experienced criminal and immigration defense attorney immediately. The stakes couldn’t be higher.
