  • Cutting, tearing, burning, or otherwise damaging property in any way
  • Breaking, destroying or injuring any wood, fence, gate, post or railing
  • Digging, taking or carrying away any earth, soil or stone
  • Tearing down, damaging or destroying any sign, notice or advertisement
  • Putting up, affixing, fastening, printing or painting any notice, bill, advertisement or name upon any property

So while graffiti is a specific type of vandalism involving markings or drawings, vandalism encompasses a wider range of destructive acts against someone else’s property. Smashing a window, slashing tires, or breaking a fence could all be considered vandalism.

Penalties for Graffiti and Vandalism in Las Vegas

The punishments for graffiti and vandalism depend on the value of the damage done:

Graffiti Penalties

  • Damage less than $250 – Misdemeanor, up to 6 months in jail and/or up to $1,000 in fines
  • Damage between $250 and $5,000 – Category E felony, 1-4 years in prison and up to $5,000 in fines
  • Damage of $5,000 or more – Category D felony, 1-4 years in prison and up to $5,000 in fines

In addition to fines and jail time, courts will order anyone convicted of graffiti to clean up, repair, or replace the damaged property. For felony convictions, the judge may also suspend the person’s driver’s license for up to 2 years.
